The old way of getting a divorce was to have a trial. Things have changed.
For most divorces, the issues are resolved by negotiation, either using attorneys, or mediators. In most cases, the parties use mediators/attorneys to negotiate the issues, and attorneys to do the work of making the agreement legal and binding.

In divorce mediation, a professional mediator acts as a facilitator. The mediator's job is to help the parties come to a fair agreement. Both of the divorcing parties participate to come to a workable settlement agreement.
After the settlement is made, an attorney will draft the papers to present to the Court for its approval and entry. At that point the divorce is legal, final and binding on both parties, and done.
